This week, AFSA’s State Government Affairs team published it’s July white paper which is an update of our evergreen paper on California E-Contracting Laws. The paper takes a deep dive into California’s Uniform Electronic Transactions Act (UETA), which allows for electronic signatures. California’s version of UETA differs from the uniform “official version” of UETA proposed by the Uniform Law Commission. This discrepancy raises questions regarding federal preemption and the treatment of retail installment contracts.
The updates discuss recent unsuccessful legislative proposals to clarify the issue since the white paper was last updated in 2017. The updates also provide an overview of recent arguments used by proponents and critics of the current law. California UETA will be a battlefront in consumer motor vehicle litigation and, possibly, legislation for the foreseeable future.
