On Monday, AFSA’s State Government Affairs (SGA) team published their November white paper covering consumer privacy legislation. Consumer privacy has risen to be one of the most crucial legislative issues in the country. In 2018, California adopted it’s Consumer Privacy Act (CCPA) and became the first state in the country to have a comprehensive consumer privacy law. Since then, over 20 states have attempted to pass similar laws, though only Colorado and Virginia have successfully enacted such legislation.
The white paper provides a background of the CCPA’s history and amendments since its enactment. Since it was passed in 2018, the CCPA has undergone multiple changes through rulemaking, legislative action, and ballot initiative. The paper also provides an overview of the major provisions of the privacy laws in Colorado and Virginia. It also looks at a preview of pending consumer privacy legislation for 2022, with a focus on exemptions for entities subject to existing federal laws and rules such as the Gramm-Leach-Bliley Act and Fair Credit Reporting Act.
The paper is also available under the State Resources section of AFSA’s website. In addition to the white paper, AFSA’s SGA team has a quick reference sheet comparing state privacy laws as well as a chart tracking privacy legislation in 2021-22.
