AFSA Comments on Draft Privacy Legislation

AFSA submitted a comment on Tuesday to House Energy and Commerce Committee Chair Frank Pallone (D-NJ) and Ranking Member Greg Walden (R-OR) regarding their draft privacy legislation. AFSA commended the Members for their efforts for meaningful reform in this area and offered some suggestions on the bill’s text.

The letter:

  • Outlined that any federal legislation should include a preemption statute to ensure businesses can effectively comply with a national standard, as opposed to many smaller ones
  • Noted that the bill should include more narrowly tailored requirements for responding to consumer requests
  • Modified to ensure that businesses are not forced to reveal proprietary information or gather that information from third parties.
