August White Paper: Trigger Lead Legislation
Last week, AFSA’s State Government Affairs team published its latest white paper, highlighting increasing attention on trigger lead legislation. The rise in these bills comes in response to growing concerns over third-party lenders using trigger leads to target consumers, often undercutting both the borrower experience and mortgage lenders’ business relationships.
Federal efforts to amend the Fair Credit Reporting Act (FCRA) are still pending, and not all states have acted on the issue. That said, there are existing tools that mortgage lenders can use to limit the effect of trigger leads. These include encouraging consumers to register on the federal Do Not Call Registry, using soft credit pulls to delay mortgage-related triggers, and offering credit improvement resources to borrowers who don’t initially qualify.
