CFPB Announces Abandoning the Non-Bank Registry for Enforcement and Supervision Prioritization
On April 11, 2025, the CFPB issued an announcement that the Bureau will not base enforcement or supervision decisions on participating in the Non-Bank Registry. The Non-Bank Registry was established to require certain finance companies to report enforcement actions and similar events as a means of “naming and shaming” the consumer finance industry.
AFSA has vigorously fought this effort from its inception. Most recently, in February 2025 AFSA led sister trade associations in requesting that the CFPB rescind the rule establishing the Non-Bank Registry. AFSA has consistently voiced that organizing bad-faith fishing expeditions is not an appropriate use of limited resources and limited authority vested in the CFPB.
AFSA appreciates the Trump administration’s review and consideration of our industry concerns and its taking initial steps to address them.
