SGA’s Letter on Colorado Automated Decision-Making Technology Act
AFSA’s State Government Affairs team submitted a comment letter to the Colorado Department of Law, Office of the Attorney General, in response to the SB 26-189 proposed rules implementing the Colorado Automated Decision-Making Technology Act, published August 11, 2026.
Building on AFSA’s July comments, AFSA asks the Department to conform the rule’s Adverse Outcome examples to the statute’s own definitions, to adopt a workable standard for “Materially Influence,” preserve the Regulation B model form safe harbor, calibrate the Meaningful Human Review standard to how credit is actually extended, and protect proprietary models and trade secrets from disclosure.
This letter, along with SGA’s other recent letters, can be found on the direct advocacy section of AFSA’s website.
